1. INTRODUCTION
Grayson Starbuck, DPT, PLLC dba Kinito Physical Therapy is committed to delivering safe, professional, and legally compliant physical therapy services directly to clients in their homes. Our operations and service offerings are carefully structured to comply with all applicable laws and regulations, including but not limited to:
• The Oklahoma Physical Therapy Practice Act (Title 59 O.S. §§ 887.1 et seq.)
• The Oklahoma Home Care Act (Title 63 O.S. §§ 1-1960 et seq.)
• Regulations set forth by the Oklahoma Board of Medical Licensure and Supervision
2. LEGAL BASIS FOR OPERATIONS
Exemption from Home Care Agency Requirements
The Oklahoma Home Care Act is primarily intended to regulate agencies that provide non-medical home care services, such as personal care and supportive home assistance. According to §63-1-1961, the Act defines “home care services” as:
“Skilled or personal care services provided to clients in their place of residence for a fee.”
However, §63-1-1962, subsection D of the Act explicitly states:
“The provisions of the Home Care Act shall not apply to a licensed health professional providing services within the scope of their license.”
Since all services provided by Kinito Physical Therapy are performed exclusively by licensed physical therapists, our practice is exempt from the Home Care Agency licensure requirements. This exemption is further supported by the Act’s definition of “Skilled Care” (§63-1-1961, point 9), which includes services provided by licensed professionals such as physical therapists.
3. SCOPE OF SERVICES
Kinito Physical Therapy offers only physical therapy services in clients’ homes, as defined under the Oklahoma Physical Therapy Practice Act (Title 59 O.S. §§ 887.1 et seq.). Our services are limited to:
• Assessment and Treatment of physical impairments and functional limitations
• Rehabilitation to restore, maintain, and promote optimal physical function
• Patient Education on mobility, strength, and safety practices
We do not provide:
• Nursing care
• Personal care services (e.g., bathing, dressing, grooming)
• Companion or sitter services as defined in §63-1-1972 of the Home Care Act
4. VOLUNTARY HOME CARE AGENCY LICENSURE
Although not legally required, Kinito Physical Therapy has obtained and maintains a Home Care Agency license from the Oklahoma State Department of Health as a precautionary measure. This strategic decision allows us to:
• Demonstrate our commitment to compliance, transparency, and safety
• Ensure we are prepared for potential future expansion of services that might trigger Home Care Agency requirements
• Provide assurance to clients, partners, and regulatory bodies of our legitimate and ethical business practices
This licensure is not an indication that we operate as a traditional Home Care Agency or offer any services beyond physical therapy.
5. PRECAUTIONARY MEASURES AND BEST PRACTICES
To uphold our standards of safety and professionalism, we voluntarily implement the following practices:
A. Regular In-Home Assessments
• All in-home assessments are performed by licensed physical therapists to evaluate the safety and appropriateness of our treatment plans.
• These assessments ensure compliance with §63-1-1964, which sets standards for assessing an applicant’s business and professional experience.
B. Criminal Background Checks
• All team members undergo criminal history background checks in line with the requirements outlined in §63-1-1962, subsection C(4) of the Home Care Act.
• We voluntarily adhere to the Department of Human Services Community Services Worker Registry to verify that no team member has a record of abuse or relevant criminal convictions.
C. Ongoing Training and Education
• Our therapists receive continuous training in areas including safety protocols, infection control, and emergency procedures, exceeding the minimum standards set by the State Board of Health (§63-1-1962a).
D. Maintenance of Professional Standards
• We ensure all physical therapy services are delivered in compliance with the Oklahoma Physical Therapy Practice Act and all applicable rules of the Oklahoma Board of Medical Licensure and Supervision.
6. FUTURE SERVICE EXPANSION
Should Kinito Physical Therapy decide to expand services in the future to include non-physical therapy home care services, we will:
• Obtain any additional licenses required under the Oklahoma Home Care Act
• Implement appropriate training and certification programs for any new service lines
• Fully comply with the State Department of Health’s licensure, oversight, and operational standards
Until such expansion occurs, our Home Care Agency license is held solely as a proactive and precautionary measure.

Kinito Physical Therapy asserts that our current service model is not subject to the regulatory requirements imposed on licensed Home Care Agencies under the Oklahoma Home Care Act. This statement serves as a formal declaration that:
